Terms of service

These terms are an agreement between you and Eskara, Inc. ("Eskara," "we") for the Eskara app and eskara.ai (the "Service"). By using the Service you agree to them.

1. Who can use Eskara

You must be at least 13 years old, and old enough to agree to these terms where you live. If you create an account, keep your password secure and tell us about any unauthorized use.

2. What Eskara is, and isn't

Eskara gives styling suggestions based on what you tell us and on product information published by retailers. Suggestions are opinions, not guarantees of fit, color or availability. Retailers set prices, stock and product details, which can change or be wrong. Always check the retailer's page before you buy.

Color and proportion analysis is for styling only. It is not a medical, health or body-composition assessment.

3. Purchases and retailers

Eskara doesn't sell products. When you follow a link, you leave Eskara and buy from the retailer under their terms, prices, shipping and return policies. Eskara isn't a party to that purchase. We may earn a commission from the retailer; see our affiliate disclosure.

4. Your content

You own what you add: profile answers, photos, saves and boards. You give Eskara a limited license to store, process and display that content only to provide the Service to you, and, for anything you choose to make public, to others. You can delete your content at any time.

Only upload photos of yourself or that you have the right to use. Don't upload content that is unlawful, explicit, or infringes anyone's rights.

5. Acceptable use

Don't misuse the Service: no scraping, automated access, reverse engineering, attempts to access other accounts, interference with security, or use of Eskara to send spam or fraudulent clicks to retailers.

6. Our content

The Eskara name, logo, app, guides and site are owned by Eskara, Inc. Product names, images and trademarks belong to their owners and appear for identification only; their appearance doesn't mean the brand endorses Eskara.

7. Free service and changes

Eskara is currently free for shoppers. We may change, suspend or discontinue features. If we introduce paid features, we'll tell you the price before you're charged.

8. Ending your account

You can delete your account at any time from the app. We may suspend or close accounts that break these terms.

9. Disclaimers

The Service is provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the extent the law allows, Eskara won't be liable for indirect, incidental, special or consequential damages, or for purchases you make from retailers. Our total liability for any claim relating to the Service is limited to $100. Some places don't allow these limits, so they may not apply to you.

11. Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before filing a claim, please contact us at hello@eskara.ai so we can try to resolve it. Nothing here limits rights you have under consumer protection laws where you live.

12. Changes to these terms

We may update these terms. For material changes we will notify you in advance in the app or by email. Continuing to use Eskara after changes take effect means you accept them.
